KIRDI Corruption Reporting Procedure

The purpose of this procedure is to give guidelines on how ethical misconduct cases should be handled in KIRDI. It forms a central part of KIRDI’s drive to ensure that the conduct of the entire institute’s staff complies with the requirements of the Public Officers Etics Act 2003, KIRDI’s code of conduct, KIRDI’s corruption policy, the Constitution of Kenya and all other written Kenyan laws.

This procedure applies to reporting and management of ethical misconduct by KIRDI staff in the framework of the KIRDI code of conduct as required by the Public officers Ethics Act 2003.

DEFINITIONS

Ethical misconduct– Any act that can be described as :- a bribery, a fraud, an embezzlement or misappropriation of public funds, abuse of office, dishonest as prescribes in any written law providing for the maintenance and protection of the public revenue, lack of integrity, lack of professionalism, dishonesty in service delivery, lack of accountability, lack of transparency, injustice, selfishness, lack of objectivity, lack of decency and other ethical misconduct as prescribed by the Public officers Ethics Act 2003.

RESPONSIBILITY

The CPC has the overall responsibility for ensuring that this procedure is effectively implemented, maintained and reviewed whenever necessary

PROCEDURE:

Every member of staff has the responsibility of reporting ethical misconducts whenever they come across them within the institute
Report on ethical misconduct can be done through the filling and submission of a prescribed format or in any form that is suitable for the person reporting.

Report on ethical misconduct can be done in either of the following ways; -

  1. Verbal reporting to the immediate supervisor or to a senior manager or to the Director. In case of verbal reporting the officer receiving the report will document the report and request the person reporting to sign against it. If the person reporting decline to sign against the report, the report will still remain valid
  2. Through a written notice addressed to the immediate supervisor or to a senior manager or to the secretary CPC or to the Director.
  3. Anonymously through a written notice addressed to the secretary CPC or the Director and dropped in to the Corruption prevention boxes provided for in the institute.

On receiving report on ethical misconduct a supervisor or a manager or the Director will forward the cases to the secretary CPC for recording and action.

The CPC secretary will then call a CPC meeting to deliberate on the reported ethical misconduct and take prescribed action as per the KIRDI’s Corruption Prevention Policy.
